Ohio Governor DeWine’s Stand: Protecting Youth’s Rights

In a defining move for Ohio’s legislative landscape, Governor Mike DeWine, a Republican, took a decisive stance by vetoing House Bill 68, known as the SAFE Act. This bill aimed to prevent medical practitioners from administering gender-affirming care to transgender minors, along with restricting transgender student-athletes from participating in girls’ and women’s sports in educational institutions.

DeWine’s decision, announced on Friday, emphasized the importance of families having autonomy in making decisions regarding gender-affirming care for their children. The governor expressed that while the bill reached his desk after passing through both legislative chambers, his choice to veto stemmed from his extensive consultations with physicians and families.

During his announcement, Ohio Governor DeWine stressed, “The state, the government, should not dictate what is best for a child when the parents, who know the child the best, should be the ones making such crucial decisions.”

This veto places DeWine in a distinct position compared to many of his Republican counterparts nationally and within Ohio, where several states have pursued similar legislation restricting gender-affirming care for minors. However, the path for the bill’s potential override remains uncertain as it necessitates a three-fifths majority in both Ohio’s House and Senate.

Ohio Governor DeWine’s decision was informed by conversations highlighting that most families seeking gender-affirming care primarily consider hormone treatment rather than surgical options. He emphasized the consensus among the consulted parties that such care must involve mental health counselling and affirmed his stance that treatment should not be accessible without prior counselling.

In his discussions with children’s hospitals, DeWine revealed that approximately two-thirds of children, following consultations, opted against pursuing medication treatment. The governor emphasized the unanimous agreement on the necessity of a comprehensive mental health focus within the gender-affirming care process.

Acknowledging anticipated disagreement within his party, DeWine reaffirmed his commitment as the state’s chief executive to follow a systematic, evidence-based approach. He expressed confidence that Ohio’s approach would set a standard for other states, focusing on evidence, careful consideration, and a meticulous review process.

The Human Rights Campaign, a prominent LGBTQ advocacy group, lauded DeWine’s decision, emphasizing the importance of empowering parents, schools, and doctors to create supportive environments for all youth, including transgender individuals. The organization applauded the governor for prioritizing the voices and needs of trans youth in Ohio.

Ohio Governor DeWine’s veto of House Bill 68 marks a significant moment in Ohio’s policy landscape, underscoring the importance of parental autonomy and a comprehensive approach to gender-affirming care for minors.
